Under the federal Fair Labor Standards Act (FLSA), non-exempt employees must be paid at least 1.5× their regular hourly rate ("time and a half") for all hours worked beyond 40 in a workweek. Some states have additional protections — California, for example, requires overtime after 8 hours in a single day, not just 40 per week.

Exempt employees (typically salaried workers earning above $684/week, in an executive, administrative, or professional role) are generally not entitled to overtime pay. Most hourly workers and lower-paid salaried workers are classified as non-exempt and protected by overtime rules.

Note that overtime pay is taxed as ordinary income — there is no special tax rate for it. However, because it's earned in addition to your regular pay, it typically pushes you into a higher effective tax bracket for that period's withholding calculation, even if your annual effective rate is unchanged.

• Overtime rate = regular hourly rate × multiplier (default 1.5 per FLSA).
• Weekly pay = (regular hours × regular rate) + (overtime hours × overtime rate).
• Annual gross = weekly total pay × weeks per year.
